General Terms

Sugar Branch Tree Company agrees to furnish all labor, equipment, tools and material required to complete tree installations as proposed. Any alteration from original specifications involving extra costs will be executed only upon specified direction and will become an extra charge to the project. All extra work will require a signed CHANGE ORDER prior to execution. All extra work requested shall be paid the day of completion.

All operations shall be completed in a workmanlike manner.

This proposal is subject to extra charges for concealed contingencies (i.e. rock, debris, poor drainage situations, etc.) not readily apparent in estimating materials and labor specified.

Location of all property lines and corners shall be the responsibility of the owner. Sugar Branch Tree Company is not responsible for any damages to underground improvements arising from excavation on owner’s property (i.e. irrigation systems, drainage, invisible dog fences, electric lines, etc.).

All zoning, building and construction permits necessary shall be the responsibility of the owner. Sugar Branch Tree Company cannot initiate work until permits are obtained.

Sugar Branch Tree Company will not be responsible for damages arising from digging on owner’s property and the striking of any improperly marked underground utilities of any sort, including but not limited to phone, electric or cable lines, gas, water or sewer lines. Sugar Branch Tree Company will contact PA One Call System, MD Miss Utility or DE One Call System one week prior to installations.

Owner will carry appropriate homeowner’s insurance. Workmen’s Compensation and General Liability Insurance will be provided by installation contractor.

Owner shall be responsible for locating any necessary sleeving installed by others.

Planting Guarantee – Installed Trees
Sugar Branch Tree Company will replace one (1) time any trees that fail to survive for a period of six (6) months after date of invoice, provided account is paid according to terms, trees receive normal and customary maintenance and report of loss is made promptly. Trees will be replaced during the next planting season. Regular charges may be made for delivery & planting. We reserve the right to apply equal credit to alternate tree varieties based on availability. Any damages from animals, vandals, Acts of God or other conditions beyond the control of the Sugar Branch Tree Company voids the guarantee. Planting Guarantee covers only those trees installed by the Sugar Branch Tree Company.

Claims
Claims must be made in writing within seven days of receipt of material. Failure to act within this time frame constitutes a waiver of all rights to claims of damages and/or shortages. It is the customer’s responsibility to inspect the order for damages and or shortages prior to signing for receipt of the delivery.

Cancellations
No cancellations are accepted for orders that have already been dug or special orders.

Payment
All orders must be paid in full at the time of purchase.

Shipping
We welcome customer’s instructions regarding shipping. In the absence of definite instructions, we will exercise our best judgment. Customers will be given no less than 3 days notice of shipment.
